This Privacy Policy explains what personal data is collected by the AIFF while You use the AIFF Web Portals and Services and the ways in which We use Your information.

The AIFF is committed, in the course of its activities and in compliance with the applicable laws on data protection, to ensure the confidentiality, integrity and availability of Your personal data, as well as to respect Your privacy.

By using or accessing the AIFF Web Portals and Services, you agree to our Privacy Policy outlined here, and the collection and use of information in accordance with it.

1. What this Privacy Policy covers:

This Privacy Policy covers the collection, storage and usage of personal data to effectively provide you with the best experience.

2. Data collection and usage:

The AIFF collects and processes Your personal data in order to provide You with a service sought by You, and for the purpose of publishing and sharing information including documents related to football. You can view certain portions of the Web Portals and Services without furnishing any personal data, however the remaining has restricted access. Such portions would only be visible to You after submitting personal data. Personal data (the “Personal Data”) can be inter alia:

Date of Birth

Telephone Number

Gender

Birth Certificate

Nationality Proof

Bank Account details

Employment Contract

Photos

Authorisation from parent(s)/ legal guardian(s)

Data relating to anti-doping process

Event Data

Performance Data

Transfer instructions and information, including fees

Status of Player (Professional/Amateur)

For the avoidance of any doubt, it is deemed that any information including Personal Data and/or non-sensitive information submitted into the AIFF Web Portals and Services is done so either by the person themselves or someone with the necessary authorisation to do so.

The Personal Data collected is necessary for administering Your account and providing You with access to the Restricted Areas and the requested AIFF Web Portals and Services. Your Personal Data is processed on the basis that such processing is necessary in order to complete Your registration.

We also use cookies to enhance the User experience while You visit the AIFF Web Portals and Services. Cookies are small files saved on the Users’ computer hard drives that track, save and store information about the Users’ interactions and usage of the AIFF Web Portals. This allows the AIFF Web Portals, through its server to provide the users with a tailored experience within the AIFF Web Portals. If in case You wish to stop the use and saving of cookies from AIFF Web Portals on to Your computer hard drives, You would be required to block all cookies from AIFF Web Portals and its external serving vendors on Your own website.

Other cookies may be stored to Users’ computer hard drives by external vendors when their website uses referral program, sponsored links or adverts. The AIFF also automatically receives and records non-sensitive personal data on its technical infrastructure logs about Your computer when You visit the AIFF Web Portals and Services, regardless of whether You have registered for an account or are just browsing our servers. The AIFF may collect, including but not limited to, Your Web browser software, Your internet protocol (IP) address, the mobile device You use (in case you use our mobile application) or mobile network information. The AIFF may also collect information about Your location with your consent, and Your online activity on the AIFF Web Portals and Services.

4. How AIFF uses personal data collected:

The AIFF uses Personal Data collected to further AIFF’s legitimate business interests by:

  • Carrying out technical administration of the AIFF Web Portals and Services;
  • Comply with the rules of football;
  • Customise the content You see on the AIFF Web Portals and Services;
  • Organising AIFF competitions;
  • Distributing funds and supporting payments;
  • Sharing information between Member Associations, Clubs and scouts;
  • Carrying out research and development to achieve and maintain a high service level;
  • Enabling You to use the various services provided by the AIFF;
  • Communicating with you through newsletters, promotional emails and announcements etc.;
  • Carrying out any other purpose for which You provided the information.
5. Disclosure of data:

All User information collected by us through the AIFF Web Portals and Services or the information generated by Users’ activity on the AIFF Web Portals and Services is maintained confidentially and not consciously shared with any third parties other than in the following circumstances:

  • To send the data to the police/state authorities, in particular to carry out security or administrative controls in relation to venues or events You have requested access to.
  • To comply with legal obligations and with the requirements of governmental, regulatory or law enforcement agencies.
  • To comply with the rules of football and the Regulations on the Status and Transfer of Players.
  • To comply with competition specific rules.
  • To protect and defend AIFF’s rights or property.
  • To protect the personal safety of Users of the AIFF Web Portals and Services or the public.
  • To share with our affiliate entities for marketing and advertising requirements in relation to our service.
  • To share with affiliate entities which provide to us products and services which in turn support the service that We provide.
  • We may also share aggregated information, which cannot reasonably be used to identify any particular User.

If the AIFF finds that it is necessary, as determined in AIFF’s sole discretion, to investigate, prevent or take action regarding illegal activities, suspected fraud, emergency situations involving potential threats to the physical safety of any persons, violations to Our Terms or as otherwise required or permitted by law.

6. Data Retention and Archiving:

The AIFF does not, as a matter of practice, retain personal data longer than necessary for the purposes stated and to comply with legal requirements, unless otherwise agreed to by You.

Data related to football players, whether professional or not (the “Players”) shall be retained by the AIFF for as long as such Players continue to play organised football.

In addition to the above, personal data shall also be retained in accordance with Clause 7 below.

7. Your right to access Your personal data:

You can access, review, correct, update or delete Your personal data at any time by accessing Your account on the AIFF Web Portals where it has been created, if any. In all cases, You can also send a formal request for accessing any personal data held by the AIFF through email at privacy@the-aiff.com.

Personal Data of Players, for eg., date of birth of Players cannot be corrected or updated by accessing Your account on the AIFF Web Portals where it has been created. Such amendments can only be done by sending a formal request to registrations@the-aiff.com.

You may also opt out of receiving promotional messages, announcements etc., by following few simple steps provided in such messages.

You have the following Rights as Users of the service:

  • Right to object – You have the right to object to us processing your personal data.
  • Right to access – You may request your personal data held by us anytime, which would be provided to you via e-mail at the earliest possible convenience.
  • Right to portability – You have the right to get a copy of your personal data transferred to you or to another party authorized by You.
  • Right to rectification – You have the right to complete any incomplete data and make any other amendments to the same.
  • Right to withdraw – You have the right to withdraw your consent given to the AIFF for collection of your personal data. Such withdrawal shall be communicated in writing to the AIFF through email at privacy@the-aiff.com.
  • Right to erasure – You have the right to request the deletion/ erasure of your personal data held by us.

Upon withdrawal of consent as per this provision, or a refusal to provide any Personal Data, You shall no longer be able to use the AIFF Web Portals and Services.

Once You delete Your information from the AIFF Web Portals and Services, the same may still be kept in our database for a minimum period of two (2) years, in order to deter fraud. However, no sensitive information shall be used for any other purpose, nor sold or shared with third parties, except as necessary to prevent fraud or as required by law or in accordance with this Privacy Policy.

8. Security of Data:

The security of your data is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect your Personal Data, We cannot guarantee its absolute security.

The transmission of information via internet though, is not completely secure and so We cannot guarantee the security of the data transmitted through the site; any transmission is at Your own risk. However, once We receive Your information, We use the following reasonable methods to prevent any unauthorised access of the same:

  • Upon collection of the information, the same is encrypted. Transport layer security mechanisms are employed to protect theft and leak of data in transit (none of it is tracked by us). We also use two-factor authentication for all sensitive User actions on the platform. We add an additional layer of security to Your data at rest in the cloud, using scalable and efficient encryption features.
  • We do not disclose Your information unless We are required to do so to provide information to government agencies mandated under the law to obtain such information or in accordance with this Privacy Policy. However, in a situation where there is clear indication of illegal conduct in connection with the use of the AIFF Web Portals or Services or We are prohibited from disclosing, We notify You before disclosing Your information so You can seek protection from disclosure.
  • We cannot protect any information that Users make available to general public (for example, on community chats). For reasons beyond our control, unforeseen security risks may arise and We disclaim any responsibility for damages arising out of such a security breach or failure. Though We will put our best efforts to secure the information, in the event of a breach or failure, information transmitted to us or from the AIFF Web Portals and Services will be at the Users’ risk.
9. Service Providers:

We may employ third party companies and individuals ("Service Providers") to facilitate and improve the AIFF Web Portals and Services, to perform Services-related services, or to assist us in analyzing how the AIFF Web Portals and Services are used.

These third parties have access to Your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

The AIFF Web Portals and Services may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

11. Violation of Privacy by User:

If any User violates the privacy of anIf any User violates the privacy of any other User by accessing or disclosing any Personal Data of any User without the prior consent of such User and on receipt of any complaint regarding such violation, the matter shall be adjudged by the AIFF Disciplinary Committee and appropriate disciplinary actions will be taken against such violator in accordance with the provisions of the AIFF Disciplinary Code.

Any complaint regarding violation of privacy of any User should be notified to the AIFF through an e-mail at privacy@the-aiff.com.

In any case where a separate legal proceeding under appropriate laws has been initiated against any violator by any User, the AIFF would be exempted from any kind of participation in such legal proceedings.

If any User violates the privacy of the AIFF by accessing or disclosing any data of the AIFF which otherwise is not to be disclosed without prior permission of the AIFF then such matter shall be adjudged by the AIFF Disciplinary Committee and appropriate disciplinary actions will be taken against such violator in accordance with the provisions of the AIFF Disciplinary Code

In any case, the AIFF may initiate a separate legal proceeding against the violator under appropriate laws.

12. Violation of Privacy by Third-Party:

If any Third-Party violates the privacy of any other User by accessing or disclosing any personal data of any User without the prior consent of such User, then the User may initiate appropriate legal proceeding against such violator under appropriate laws. In any case, AIFF would be exempted from any kind of participation in such legal proceedings.

If any Third-Party violates the privacy of AIFF by accessing or disclosing any data of AIFF which otherwise is not to be disclosed without prior permission of AIFF then the following actions can be taken against such violator:

  • Appropriate legal proceedings can be initiated against the violator;
  • Blocking further access to such violator;
  • If the violator has a business relation with AIFF, then such violator can be blacklisted for any such future business activity.
13. Children’s Privacy:

If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us on privacy@the-aiff.com. If We become aware that We have collected Personal Data from children without verification of parental consent, We take steps to remove that information from Our servers.

14. Changes to this Privacy Policy:

The Privacy Policy is available at any time through the AIFF Web Portals and Services and may be amended from time to time. We shall place an updated version on the AIFF Web Portals and Services.

We may change this Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this website (https://www.the-aiff.com/). We expect You to review the same whenever You use any of Our Web Portals and Services.
